VEHICLE - Any vehicle, including cars, motorcycles, caravans, trailers, campers, vans, trucks, etc.., for private or public, for the transport of persons or property, traveling with the passenger train.
PASSENGER - Any person on board the ship which is not the captain, a crew member or other person employed or engaged in any capacity on board a ship for his services.
Art. 1 RECRUITMENT OF SERVICE - The Company takes the carriage of passengers, luggage and vehicles are carried in the following general conditions of carriage which are properly published at all appointees ticketing company in the ports of embarkation, offices and social website . The extract of the conditions governing the transport on ships and fast boats of the company is listed on the ticket. The general conditions of carriage are subject to changes and modifications to make them consistent with applicable regulations. The text of a presence on the Company's website (www.toremar.it), is what is authentic for the purpose of identifying the contents of the contract.
Art. 2 AMOUNT OF THE TICKET - The total amount of the ticket is composed of a lower rate to any other rights identified separately. The fees charged by the Company include VAT when due. For rates see the 'tariff' of the Company which is part of this Regulation.
Art. 3 CHILDREN AND ADOLESCENTS - Children under 12 must be accompanied by an adult passenger. For discounts applied based on age, see the fee schedule.
Art. 4 EASY TRAVEL - The Company grants the travel facilities where required by the tariff. The facilities established for the benefit of those who are entitled to exclusive rates are applicable, then, all the accessories. If the passenger is entitled to more facilities will be charged only the most favorable, not being allowed a combination thereof. Passengers beneficiaries of the facilities must be provided in the document that gives right to the same facility and are required to produce it on request to the crew and / or officers of the Company. Those found lacking in that document will be required to pay the difference between full fare and the reduced rate they received, plus the right provided for in the tariff collection on board.
Art. 5 TICKETS - To travel on ships and fast boats of the Company, the passenger must be equipped with a regular ticket, which proves the conclusion of the contract for the journey shown on the ticket, the vehicles are registered on the ticket or tickets in connection with the passenger ticket. This ticket must be retained for the duration of the trip and presented at the request of personnel of the Company. Those in control of the personnel of the Company will be found without a regular ticket will be required to pay the full ticket price plus the right to board provided for in the tariff collection. The vehicle that is without a ticket or receipt of a facility without authority or that it is tickets to a lower class or length is required to pay the difference with the ordinary rate plus the right of collection on board. Tickets for both one way and return that are only valid for departures in the latter. In case of loss, destruction or theft of the ticket, to go on board, must be purchased a new ticket. Tickets issued on board do not apply to facilities beyond those provided for residents, who are entitled to facilities and / or reductions otherwise, must apply to the offices of the difference between the price charged and that they are entitled.
Art. 6 RESERVATIONS - Requests for reservations of seats and / or garage spaces can be made ??in good time before departure at the ticket office of the Company in the ports of embarkation, at the authorized travel agencies and possibly through other channels from time to time advertised by the Company. Requests for reservation or purchase a ticket shall specify the date and time of departure, port of embarkation, the port of destination, the number of passengers, vehicle type, as well as provide any useful indication of likely identification of the applicant or applicants and the correct application of tariffs. For each site and / or garage space reserved on the issue of the ticket, a reservation fee is due to the extent provided by that scale. The request for a reservation, whose stock has not been previously confirmed by the purchase of the ticket, not binding in any way the Company, which is not liable for lack of seats and / or garage spaces.
Art. 7 LOADING - UNLOADING - STAY ON BOARD -Passengers with any accompanying vehicles are required to appear before boarding, with a regular ticket at least thirty minutes before departure of the vessel or faster; after this deadline will not be granted embarkation. Passengers holding tickets issued before the day of departure, are required to ensure that there are no changes beyond the control of the Company, regarding the service for which the ticket was issued. The loading and unloading of vehicles accompanying passengers are carried by the passenger. The loading and unloading take place in the order and criteria from time to time established by the board Command. Boarding the vehicle is due principally to the implementation of the journey to the needs of the vessel and any other requirement in any way connected to the vessel's seaworthiness and safe navigation. All this reasoned opinion of command as required by the rules, even if between the passenger and the company has taken on the agreed 'reserve area' (reservation). The boarding and embarkation and disembarkation of passengers and vehicles are regulated by law, by the orders issued by the Command of the ship in relation to particular situations, as well as by the following:
a. except as provided in paragraph 2 of Article .192 of the Navigation Act, the boarding of passengers clearly suffering from serious illness or otherwise hazardous to the safety of navigation, and for the safety of persons on board, is conditioned the authorization given by the competent health authorities;
b. although there is no danger to the safety of navigation and the safety of persons on board, embarkation of passengers who are obviously in physical conditions to discourage travel by sea, is required in the interest of the passengers themselves, medical certificate authorizing the execution of the trip or the release by the same passenger, in a statement that raises the command board from liability for damage to his health, resulting from the holiday;
c. will not be allowed to board passengers in a state of agitation or in clear and disturbing state of drunkenness;
d. must be used for maritime transport in relation to the peculiarities of that transport, efficient vehicles in every part, especially with regard to the organs of the brake, running gear, suspension and where required, lashing;
e. you must present the boarding vehicles with load packed, arranged and authorized in a workmanlike manner and with any devices and systems of care required by the type of goods and type of vehicle, all in a manner suitable for transportation by sea ;
f. is required for drivers of vehicles to the following:
- Engage in a low gear and pull the bottom of the parking brake;
- Remove the keys from the dashboard and turn off all electrical equipment;
- Turn off the alarm system;
- For caravans and motor homes, close all gas valves and unplug all electrical appliances;
- The state where you left the vehicle must comply with the rules laid down by the Maritime Authority.
g. is required to declare control board before boarding, the transportation of vehicles powered by LPG / methane or other gases.
The transport of refrigerated vehicle is subject to the rules of the RINA (Italian Naval Register), as well as regulatory standards issued by the competent authorities in the field, rules that prohibit the use of energy sources on board a vehicle. The Company reserves, in the passenger's request, following which the vehicle travels, and subject to the availability of the ship, to provide electricity on board, provided that the vehicles are equipped with the special anti-graft explosion. In the case of electricity supply board, any interruption in the supply of that energy from the vessel for any reason or cause, without exception and the exception, or by changes in voltage, does not involve responsibility for the command, for it , of the Company, as the passenger acknowledges that the connection with the on-board is at your own risk and under his responsibility, even in dealings with third parties. The supply of energy can also be suspended from the control board when the vehicle engine refrigerator is not clear, in the opinion of that Command, which operates regularly and did not offer adequate guarantees of security for the cargo and the ship. For the purposes of his own safety passengers are required to comply with the provisions on safety given by signs, as well as audio messages sent directly from the crew.
Art. 8 LUGGAGE - OEach passenger is entitled to bring with you for free gross 20 kg of hand luggage, when traveling on ferries and 10 in the case of travel on fast. The boys paying half price, half the relief is granted, or 10 kg. In the case of ships and 5 in the case of high speed vessels. Are considered and accepted as checked the effect that, for personal use of the passenger, are routinely transported in suitcases, travel bags, boxes and the like. If you include other items in checked baggage, the passenger must double the price to charge for carriage of the things themselves, as well as damages. The Company disclaims any responsibility for the theft of objects and / or luggage left unattended, they must always remain within the sphere of control of the passenger. As regards the responsibility of the Company; are the rules laid down in Articles. 411 and 412 of the Navigation Act.
Art. 9 PLEDGE ON LEGAL BAGGAGE - The Company has the right of lien on the baggage for receivables arising from the passenger transport contract. When the passenger to fulfill his obligations, the Company is required to deliver the luggage to the place specified in the contract. If the passenger fails to fulfill its obligations under Article. 416 of the Navigation Act, the Company may proceed with the sale of luggage in accordance with the rules of the Civil Code in force (Articles 1515, 2797 of the Civil Code and 83 of its implementing rules).
Art. 10 PETS - Unless otherwise required by law, is allowed to transport dogs, cats and other small live animals accompanying passengers. Dogs must have a leash and muzzled, the other small animals must be housed in a cage or basket, to assist passengers. Passengers with the following animals must remain in designated areas reserved for animals in shelters or stay on board, where half the water will be provided. With the exception of guide dogs for the blind. The transport of pets and their maintenance and care are borne by the holders. The transportation of pets accompanying passengers is also governed by the provisions laid down in health by the competent authorities. The passenger agrees to hold harmless the Company from any liability and responsibility that may arise in the same consequence or effect of failure on his part of the rules above mentioned regulations and the laws in this field. The Company is not liable for accidents that may affect pets, if the event is attributable to causes not attributable to it. The transport of other animals can only be made on ferries using only special vehicles, and duly approved in travel and timetables agreed in advance with the Company.
Art. 11 DANGEROUS GOODS - The transport of flammable, explosive, corrosive and dangerous, in commercial vehicles are allowed on vessels that have the capacity to transport and, as far as approval, in accordance with current standards. The passenger is obliged to declare to the Company prior to boarding the existence of dangerous goods, which must be presented for boarding under the conditions prescribed by law. The services referred to in this Article shall, however, be announced to the Company and the agent at the port of embarkation, at least three working days in advance.
Art. 12 REMOVAL OF VEHICLES AND STORAGE - The ship passengers should promptly withdraw their vehicles. In any case you will be entitled to abandon the vehicles loaded to the Company even if damaged or otherwise depreciated. If the passenger fails to disembark the vehicle and it remains on board, its cargo will be charged to the passenger. No claim for damages, loss or other damages suffered by accompanying luggage or vehicles will be permitted if the state thereof is not recognized in contradiction with the arrival on board Command and is not to adjust the minutes in the case of apparent damage.
Art. 13 PROHIBITIONS - It is strictly forbidden:
a. hold behaviors or attitudes that are, or may cause annoyance or nuisance to other passengers;
b. exercise on board the craft vendor, a singer, musician, etc. and provide accompanying services or passengers;
c. introduced in the halls animals or things that may disturb passengers or which are contrary to the rules of hygiene and decoration, unless the exception provided in the third paragraph of Article 10;
d. lie on the sofa;
e. smoke in the interior of the vessel;
f. open and close the door and windows, furniture and equipment as well as tamper-board, as above, passengers must contact the ship's personnel;
g. wear or hold arms and ammunition in the luggage, they must be delivered to the command of the ship and boarding will be withdrawn only upon landing, are subject to the applicable regulations governing the carrying of arms for the staff of the Armed Forces and Police ;
h. carry with them in luggage or in a vehicle in tow, flammable, explosive, corrosive. or otherwise dangerous, and charged with oxygen cylinders, compressed air, gas and the like;
i. deliver letters and parcels subject
in postal charges;
j. objects thrown into the sea of ??any kind;
k. stay inside the vehicle during the crossing;

Art. 14 HINDRANCE BY BOAT - ELIMINATION OF DEPARTURE - CHANGES TO ITINERARY - DEPARTURE DELAY - PRIOR TO DEPARTURE FOR ACTS OF GOD - BREAK OF JOURNEY - If the departure of the ship or the vehicle speed is prevented due to causes not attributable to the Company, the contract is terminated and the Company is required to refund the price received. (art.402 Navigation Code) Subject to the interconnection between the various reports of military traffic by the Company shall apply the rules of artt.403, 404.405 and 406 of the Navigation Act.
Art. 15 IMPEDIMENT PASSENGER - NON-STARTING AND STOPPING THE PASSENGER'S JOURNEY - REIMBURSEMENT - Travel cancellation must be communicated by the passenger, as follows:
- Up to two hours before departure at any of the Company's authorized travel agencies, ticket sales, or at the ticket calls;
- up to thirty minutes before departure at the ticket office of the port of embarkation.
In this case the contract is terminated and the passenger is entitled to the refund of the ticket application of the penalty determined by the following percentages:
- 10% for trips canceled until the day before departure.
- 25% for trips canceled on the day of departure and up to 30 minutes before that.
The booking fee is never refunded.
Any opportunity to surrender even in subjects other than those described above, will be exhibited in the artwork distributed by the Company. The right to reimbursement of trips canceled as stated above, it requires - in any case - after six months from the date of departure indicated on the ticket. No refund is not due for trips canceled within the terms above mentioned. If the passenger is forced to break the journey for reasons not attributable to him, the ticket price is due in proportion to the part usefully completed. If your trip is interrupted due to the passenger, the Company is not obliged to refund the difference in the price relevant to the unused part (art.406 Navigation Code).
Art. 16 RESPONSIBILITY - The masters and officers of the judicial police and, as such, shall exercise the powers referred to artt.221 and following of the Code of Criminal Procedure, if crimes are committed on board during navigation and exercises its authority on all persons on board (crew and passengers). He has disciplinary powers of police and safety of navigation. The passenger, from embarkation to disembarkation, must follow the norms established by the control board, must also orient their behavior to the common care and prudence, safety and ensuring their safety, people and animals that are under his care, and on the security of his goods, which require more if the weather conditions of the trip. The Company is responsible for accidents to passengers which could occur from the start until completion of disembarkation and losses or damages of the things that the traveler carries with it though does not prove that the events are derived from cases to its sphere of responsibility. They are without prejudice to cases where the event resulting from causes not attributable to the Company, to negligence by the passenger of the requirements established by the command ship for the Safety of Life at Sea. The Company does not accept any responsibility for loss or damage caused to vehicles being embarked or things contained therein by any other vehicle, unless they are directly attributable to it. Any claims will be settled directly between the parties involved.
Art. 17 PRESCRIPTION - Rights under the contract of carriage of passengers and baggage, shall lapse with the expiry of the deadline imposed by Art. 418 of the Navigation Act. In each case, subject to the terms provided in the preceding paragraph of this article, the passenger who suffered losses to their individual employees from events occurring at the start boarding until the completion of the landing, he should still report it to control board prior to landing final.
Art. 18 COMPLAINTS - The passenger, if noticing irregularities or deficiencies in the service provided by the Company may notify the board of control or management of the Company.
Art. 19 PRIVACY -According to article 13 of Legislative Decree no. 196 of 30.06.2003, containing provisions on the protection of personal data, the Company, as owner of the information that the personal data supplied by the passenger will be used for purposes strictly related to the management of the contract and the provision of services, including through systems which ensure the security and confidentiality.
Art. 20 REFERENCE - For anything not provided in these conditions of carriage, that the provisions of the Navigation Code, the Civil Code and other applicable laws.
